2. Deliveries on orders are not guaranteed against crop failure, fire, flood, frost, or other conditions beyond our control.

3. We reserve the right to omit any part of an order should unexpected and unavoidable crop shortages occur. When this occurs we will contact purchaser in order to substitute equal variety, or better, unless Purchaser indicates otherwise.

4. All prices are in US dollars. F.O.B. our warehouse.

5. Title to merchandise passes to Buyer upon delivery by Seller into hand of carrier at point of shipment. Schilling Greenhouses, Inc., is not responsible for loss, damage, or delay in transit via public or private carrier. All claims must be made with the carrier.

6. Customers must inspect shipments on arrival and notify Seller by telephone or fax within 24 hours of receipt for any claims relating to defective goods or nonconformance to order. To obtain credit, written notice of claimed defect, or nonconformance must be received by Schilling Greenhouses, Inc., within 15 working days of Buyer's receipt of goods. All goods subject to credit request must be held and made available for inspection by Schilling Greenhouses, Inc., or its agent.

7. We give no warranty; expressed or implied, as to description, quality, productiveness, or any other matter of any plants we sell. We are not responsible for the results of growing our plant material. It is agreed between the customer and Schilling Greenhouses, Inc., that we shall not, at any time, be held responsible for an amount greater than the original purchase price of the plant material.

8. Our scheduled delivery area includes all of Louisiana and Mississippi by our trucks. Our  grasses ship weekdays by Federal Express, U.P.S., and are F.O.B. Bogalusa.
